This Privacy and Data Use Policy explains how we collect, use, and safeguard information when you use Patenter, including information provided in invention disclosures, patent drafting workflows, and related services.

When you use Patenter, Berkeley Fit may collect:

  • Invention Disclosure Information: Technical descriptions, documents, drawings, and any intellectual property–related information you upload.

  • User Information: Name, contact details, and account credentials.

  • Usage Data: Logs, metadata, and analytics about how the Service is accessed and used.

2. How We Use Information

Berkeley Fit uses information collected through Patenter to:

  • Deliver the Service, including drafting, organizing, and analyzing invention disclosures.

  • Improve functionality, usability, and user experience.

  • Communicate with users regarding updates, support, and service notices.

  • Meet legal, compliance, and contractual obligations.

3. Confidentiality of Invention Disclosures

  • All invention disclosures and related submissions remain confidential.

  • Information is not shared with third parties except as required for providing the Service (e.g., cloud hosting, security monitoring) or as required by law.

  • Users retain ownership of all intellectual property contained in their submissions.

4. Use of Artificial Intelligence (AI) Services

  • Use of AI Services
    Patenter uses artificial intelligence (“AI”) and machine learning technologies to assist users in preparing invention disclosures and related documentation. These technologies are applied solely to improve the functionality and efficiency of the Patenter product.

  • No Use of User Data for Model Training
    Your confidential information, including invention disclosures, personal data, and any associated files, is not used to train or retrain external AI models. AI services may process your data in real time to generate outputs, but the underlying models are not enriched or modified with your information.

  • Confidentiality and Security
    All AI-assisted processing occurs under the same confidentiality, access control, and security standards described in this Policy. Data shared with AI services remains subject to encryption in transit and at rest and is never made available to other customers.

  • Output Responsibility
    AI-generated content is provided as a tool to support your drafting and review process. Patenter does not guarantee that AI outputs are legally accurate, complete, or suitable for your specific use case. You are responsible for reviewing and validating all content before submission to the U.S. Patent and Trademark Office or any other authority.

  • Human Oversight
    AI suggestions are intended to augment, not replace, professional judgment. Users should exercise discretion and seek qualified legal advice when necessary. Patenter does not provide legal services or legal advice, and no attorney-client relationship is formed through the use of AI functionality.

5. Data Security

  • Berkeley Fit implements industry-standard security controls (encryption in transit and at rest, access controls, monitoring).

  • Access to invention disclosures is restricted to authorized personnel and systems.

6. Data Retention

  • Invention disclosures and user data are retained for as long as your account is active or as needed to provide the Service.

  • You may request deletion of your data at any time, subject to legal and contractual obligations.

7. Your Rights

Depending on your jurisdiction, you may have rights to:

  • Access, correct, or delete your data.

  • Restrict or object to certain processing.

  • Request portability of your data.
